The WTO announces that Australia has Approved the WTO’s Government Procurement Agreement (GPA) and submitted its accession instrument to the WTO Secretariat on April 5. The announcement stated that Australia will become the 48th WTO member subject to the GPA. The GPA will be 30 days from the date of submission of the accession instrument Day (ie May 5, 2019) entered into force for Australia. Review of six regional trade agreements WTO announced that members reviewed six regional trade agreements (RTA) at the committee meeting. Trade policy review: The fifth review of trade policies and practices in Bangladesh, Samoa and Bangladesh took place from April 3 to 5, 2019. AfCFTA was signed by 44 member states of the African Union (AU) on March 21, 2018, followed by 8 member states, and now requires 22 ratifications to enter into force. According to the terms of the AfCFTA, the agreement requires 22 approvals to take effect. The latest changes to Schedule 3 of the U.S. Additional Tax Relief Order ("Reduction Order") were made in accordance with the Order No. 2019-1 Amending the U.S. Additional Tax Relief Order and became effective on April 15, 2019. In response to the additional tariffs imposed by the United States on Canadian steel and aluminum, the Canadian government has taken reciprocal countermeasures against steel and aluminum imported from the United States on July 1, 2018, in order to protect the competitiveness of companies affected by Canadian countermeasures. Announced:  Certain steel and aluminum products will be eligible for exemption from additional taxes paid or payable under the U.S. Additional Tax Order (steel and aluminum);  Certain other products will be eligible for exemption from additional taxes paid under the U.S. Additional Tax Order (other goods) Or additional taxes payable. Baker McKenzie International Trade Compliance Update | May 2019 8465028-v6\WASDMS 9 The goods currently covered in Schedule 1, Schedule 2, Schedule 3, and Schedule 4 of the relief order are as follows.  For the goods in Schedule 1, an indefinite reduction or exemption will be granted to steel and aluminum products imported from the United States on or after July 1, 2018.  For goods in Schedule 2, a limited period of exemption will be granted from July 1, 2018 to April 30, 2019, which applies to steel and aluminum products imported from the United States.  For goods in Schedule 3. The reduction or exemption for steel and aluminum products imported from the United States is limited to specific listed importers, and is subject to applicable conditions for a specific period of time, as described in Schedule 3.  For the products in Schedule 4, for other products imported from the United States on or after July 1, 2018, an indefinite reduction or exemption will be granted in accordance with the applicable conditions specified in the reduction or exemption order. The latest changes to Schedule 3 of the Relief Order were made in accordance with the Order No. 2019-1 Amending the U.S. Additional Tax Relief Order and became effective on April 15, 2019. The changes to Schedule 3 of the relief order are shown in bold as follows, including: Amendments to items 124, 127, 128 to 130, 142, 144 to 200, and 209 to 219;  Added items 220 to 314. Please refer to the Ministry of Finance notice for the full timetable of the reduction and exemption order. Canada canceled safeguard measures for five types of steel on April 28. Customs Notice 18-17-The temporary safeguard measures imposed on certain steel products were revised on April 16, 2019 to reflect the Canadian International Trade Tribunal (CITT). ) The findings in its report are after the investigation of safeguard measures for seven types of steel products [see below]. According to the provisions of the order implementing temporary safeguard measures, if CITT recommends final safeguard measures, the temporary safeguard measures shall be effective within 200 days from the effective date.  CITT has recommended final safeguard measures for the import of heavy plates and stainless steel wires; therefore, the temporary safeguard measures for these goods will remain in effect until May 12, 2019 (inclusive). According to Canadian law, if CITT does not recommend final safeguard measures, the provisional safeguard measures effectively take safeguard measures within 200 days from the date of implementation of the interim safeguard measures.  CITT does not recommend final safeguard measures for the import of concrete steel bars, energy pipe products, hot-rolled plates, color-coated steel and wire rods; therefore, the temporary safeguard measures for these goods will be effective until April 28, 2019 (inclusive) . The government is reviewing CITT’s recommendations and will issue further announcements in due course, including additional taxes on goods subject to temporary safeguard measures. Baker McKenzie International Trade Compliance Update | May 2019 8465028-v6\WASDMS 10 Before the expiration of the temporary safeguard measures, importers must continue to obtain import licenses for certain goods or pay additional taxes for importing these products. CITT releases steel safeguard investigation report On April 4, 2019, the Canadian International Trade Tribunal (CITT or the tribunal) issued its April 3 safeguard investigation report on the import of certain steel products [Investigation No. GC-2018-001]. CITT was ordered to conduct safeguard investigations on certain steel products imported into Canada. The categories of goods requested for quotation are: (1) thick plates, (2) concrete steel bars, (3) energy pipes; (4) hot rolled plates, (5) painted steel, (6) stainless steel wires, and (7) wire rods. The purpose of the investigation is to determine whether any of these commodities are imported into Canada in such increased quantities and conditions, which has become the main cause of serious harm or threat to domestic producers of such commodities. The order instructed the arbitral tribunal to consider Canada’s rights and obligations in international trade. The order stipulates that certain imported products are not included in the investigation of the arbitral tribunal-that is, imports from the United States, Israel and other Canada-Israel Free Trade Agreement (CIFTA) beneficiary countries, Chile and Mexico (except energy pipe products and wire rods) ). The order requires the arbitral tribunal to make a separate decision on the subject goods originating from certain free trade agreement partners and importing from certain free trade agreement partners when it determines that imports have increased, severely damaged or threatened to increase. The arbitral tribunal must also determine whether energy pipe products or wires originating in and imported from Mexico do not account for a significant portion of the total energy pipe products or wires imported, or whether they do not make a significant contribution to serious injury or the threat of serious injury. It also outlines the specific treatment of imports from countries enjoying General Preferential Tariff (GPT). The arbitration tribunal’s decisions and recommendations are as follows:  The arbitration tribunal believes that the import volume and conditions of heavy plates from relevant countries (except for goods originating in South Korea, Panama, Peru, Colombia and Honduras) have increased, which has caused serious damage to domestic industries. The main reason for the threat of damage, and it is recommended to take remedial measures in the form of tariff quota (TRQ) from the target country (except for originating goods in South Korea, Panama, Peru, Colombia, Honduras or other countries/regions) whose products meet the GPT processing conditions.  The arbitral tribunal held that although the import of concrete steel bars from relevant countries has increased significantly, this increase and the conditions for importing related steel bars have not caused serious damage, nor will it cause serious damage. As far as Title III is concerned, if someone “trades” confiscated property knowingly and deliberately, without the authorization of any U.S. national who owns the property: 1. European Union Blockade Regulations and Helms-Burton Due to concerns about the extraterritoriality of the Helms-Burton clause, the European Union implemented Regulation No. 2271/96 ("Blockade Regulations") in 1996 shortly after the promulgation of the Helms-Burton Act. pass through. It’s also worth noting that contract terms seeking to comply with blocked U.S. sanctions (and therefore violating blocking regulations) are likely to be considered unenforceable. In addition to the sanctions imposed on Cuba by the United States, the embargo regulations also attempt to offset the impact of certain sanctions on Iran. Canadian Foreign Extraterritorial Measures Act and Helms-Burton Baker McKenzie International Trade Compliance Update | May 2019 8465028-v6\WASDMS 29 On October 9, 1992, Canada issued the 1992 Foreign Extraterritorial Measures Act under the Foreign Extraterritorial Measures Act (FEMA) (United States) Order ("Order"). The order criminalized Canadian companies’ compliance with U.S. laws against Cuba. A "Canadian company" is defined as a company that is registered or established under the laws of Canada or a certain province, and conducts business in Canada in whole or in part. After the passage of the Helms-Burton Act, Canada made further amendments to FEMA, which took effect on January 1, 1997. These amendments apply to actions initiated under Title III, allowing the Attorney General of Canada to: "block" orders declaring that judgments issued under Chapter III will not be enforced or recognized in Canada;  Issue orders restricting or prohibiting the production of records in Canada or Provide information related to the enforcement of Title III actions in the United States;  Allow Canadians to recover in Canadian courts any amount awarded under Title III rulings, as well as their own court costs in Canada and the United States.
